Constitutional Court's decisions are final and binding, European Union's ambassador in Bosnia and Herzegovina said Thursday, commenting on the Serb leadership's step towards blocking of the decision-making process at the state-level after the State Constitutional Court ruled that a law in Bosnia's Serb-dominated region, Republika Srpska, was unconstitutional.
“In every society, there has to be a final instance, an arbiter, independent body in the decision-making. One of the axes in this country is the Constitutional Court of Bosnia and Herzegovina, and its decisions are legally binding and final,” said Johann Sattler, the Head of the EU Delegation in Bosnia.
“Here, at this moment, we are speaking about certain moves from Banja Luka, but I must say that the rest of the country, the Federation of Bosnia and Herzegovina (Bosniak-Croat entity) and the level of Bosnia and Herzegovina are not implementing a significant number of previous decisions passed by the Constitutional Court. The failure to implement these decisions leads to the legal uncertainty and legal vacuum,” he added.
The statement comes days after Bosnia's Constitutional Court assessed as unconstitutional the RS’ entity law on public land, which led the Serb-majority leadership to pass a decision on blocking the decision-making process at the state level.
They said the decision will remain in force until foreign judges are removed from the Constitutional Court.
