Bosnia’s Constitutional Court rejected on Thursday a request submitted by MPs from Bosnia’s Serb-majority region to review the decision of the Central Election Commission (CEC) to postpone the local election, saying it does not have jurisdiction in the matter.
The election was supposed to take place on October 4 but was postponed for November 15 since the state budget was not adopted which means no funds were allocated for elections.
In May, 28 MPs from the parliament of Bosnia’s semi-autonomous Republika Srpska (RS) entity asked the Constitutional Court to determine whether the decision CEC decision to postpone the 2020 local elections was legal.
Radovan Kovacevic, the spokesperson of the ruling Bosnian Serb Party, the Alliance of Independent Social Democrats (SNSD), told N1 when the request was submitted that the CEC only has authority to postpone elections in one electoral unit by 30 days at most.
The Constitutional Court, however, said that this is a case that should be treated by Bosnia’s State Court, as well as that it can not decide on the legality of decisions but only on whether such decisions are in line with the Constitution.
