BiH Constitutional Court invalidates RS entity Law on Immovable Property

In ruling on Thursday, Bosnia’s Constitutional Court annulled the Law on Immovable Property which was adopted in the country’s Republika Srpska (RS) region, ruling that the semi-autonomous entity does not have the constitutional authority to decide on the matter which is under the jurisdiction of the state. The court reviewed the RS law on a request submitted by six BiH House of Peoples representatives.


The court reiterated its position from earlier decisions that the state tried to resolve the issue through the formation of the Commission for State Property.

The High Representative of the international community in Bosnia and Herzegovina, Christian Schmidt, also took action regarding the matter.

In April, Schmidt used his Bonn Powers to suspend the RS law pending a Constitutional Court decision.

The Constitutional Court concluded that the issue has not yet been resolved and that there is a real necessity and a positive obligation for BiH to resolve the issue as soon as possible.
