BiH Council of Ministers seeks urgent legal resolution for Viaduct arbitration case

At the session of the Council of Ministers of Bosnia and Herzegovina, the BiH Attorney General's Office was requested to urgently submit a proposal for resolving the legal issues in the case of Viaduct d.o.o. Portoroz, Vladimir Zevnik, and Boris Goljevscek vs. Bosnia and Herzegovina concerning the enforcement of the ISCID Committee decision by the next session.

The information will include an overview of the Council of Ministers’ obligations, aiming to reduce adverse impacts on the BiH institutions’ budget and outline future steps for fulfilling obligations arising from the previously signed agreement between the BiH Council of Ministers and the Government of Republika Srpska, which committed Republika Srpska to cover all costs of this arbitration process.

The BiH Attorney General's Office was also requested to provide information on the legal resolution of other arbitration cases against BiH, including the arbitration case of Pramod Mittal and others against Bosnia and Herzegovina concerning the investment in Global Ispat Koksna Industrija (GIKIL) d.o.o. Lukavac. The governments of the Federation and Tuzla Canton previously refused to sign an agreement to secure funds for this arbitration process.

The session reiterated the obligations of the BiH Attorney General's Office regarding the protection of Bosnia and Herzegovina's property and property interests.

It is worth noting that the Arbitration Council in London rejected the request of Republika Srpska to annul the decision of the arbitration court in Washington earlier this month, meaning that RS, in this case, BiH, must pay the Slovenian company Viadukt 90 million convertible marks (46 million euros) as compensation for the unilateral termination of the contract for the construction of the hydroelectric power plant on the Vrbas River.

In 2004, the RS government signed a concession agreement worth 165 million euros with HEV Vrbas, majority-owned by Slovenian Viadukt, for the construction of two hydroelectric power plants.
