ECHR appellant will request Bosnia's exclusion from Council of Europe for not implementing ECHR rulings

Azra Zornic, who won a discrimination case against Bosnia and Herzegovina (BiH) at the European Court of Human Rights (ECHR) and filed a criminal complaint against Croat Democratic Union (HDZ BiH) leader Dragan Covic for not enforcing the court's decisions, stated in Sarajevo that she will continue her fight by communicating with the Council of Europe's Committee of Ministers. Speaking at a session of the Association of Independent Intellectuals, Krug 99, on the topic “BiH against the rulings of the European Court of Human Rights,” Zornic emphasized that her fight will also continue through new criminal and disciplinary charges against those responsible for not implementing ECHR rulings. She asserted that building a modern democratic state in BiH requires enforcing all such decisions.

Legal scholar Enver Iseric, the second speaker, noted that the mandates of BiH Council of Ministers agents, who filed an appeal in the “Slaven Kovacevic v. BiH” case before the ECHR, had expired, and they lacked legal legitimacy to communicate with the court or file unfounded appeals.

Iseric also clarified that appointing ambassadors and other international representatives of BiH falls under the Presidency's jurisdiction, not the Council of Ministers.

He added that the agents are preparing a request to bring the Kovacevic case before the Grand Chamber of the ECHR, unnecessarily and unjustifiably further jeopardizing the rights of BiH citizens.

Iseric explained that the difference with the Kovacevic ruling is that while previous decisions focused on citizens’ right to be elected, the Kovacevic case established the violation of his right to vote for the Presidency and delegates in the BiH Parliamentary Assembly.

He highlighted that the Kovacevic ruling dealt a significant blow to those advocating for human rights violations, marking an end to their manipulation, rights violations, and the incitement of ethnic hatred and division among BiH's peoples and citizens.
