Bosniaks in RS entity Council of Peoples to invoke national interest protection

Bosniak Caucus in the Council of People of Republika Srpska entity will invoke the mechanism of the vital national interest protection regarding the law on ignoring the decisions of Bosnia's Constitutional Court, which the entity parliament adopted on Tuesday.

“Either on Monday or Tuesday next week we will hold a session of the caucus and put the veto, so during the month there is no way this law is coming into force,” said caucus chairman Alija Tabakovic.

According to procedure, the request of the Bosniak Caucus will first be discussed by the Council of Peoples, which needs to confirm every law adopted by the entity parliament.

If a caucus of one of the three constituent peoples, the Serbs, the Bosniaks and the Croats, initiates a mechanism to protect vital national interests, then the laws or decisions in question go to the Joint Commission of the Council of Peoples and the National Assembly for harmonization.

If agreement is not reached there, then the final decision on disputed laws is made by the Constitutional Court of Republika Srpska entity.

“We do not expect that the Constitutional Court of the RS will work in our favor, because at the very session of the National Assembly, (entity president) Milorad Dodik was accompanied by Dzerald Selman, the president of this court controlled by Dodik. After that, we are left with a possibility of an extraordinary legal remedy – sending an appeal to the Constitutional Court of Bosnia and Herzegovina, which can be done either by members of the BiH Presidency or an authorised number of parliamentarians at the state level,” said Tabakovic.
