Bosnian Prosecutor's Office dismisses genocide denial charges against Dodik and Cvijanovic

The Institute for Research of Genocide Canada (IGK) has received a response from the Prosecutor's Office of Bosnia and Herzegovina regarding their criminal complaints against Milorad Dodik, President of the Republika Srpska, and Zeljka Cvijanovic, a member of the Presidency of Bosnia and Herzegovina.

The IGK had filed complaints against Dodik and Cvijanovic for violating the Law on the Prohibition of Genocide Denial. The complaints also included accusations of attempting to undermine the constitutional order of Bosnia and Herzegovina, as well as threatening the territorial integrity, sovereignty, independence, and political-legal subjectivity of the country.

The complaints highlighted that Dodik and Cvijanovic issued a decree stating that amendments to the Criminal Code of Bosnia and Herzegovina—introduced by former High Representative Valentin Inzko, which criminalized the denial of genocide and other crimes adjudicated by domestic and international courts—would not apply in the Republika Srpska entity.

However, the Prosecutor's Office has issued orders not to proceed with an investigation against Dodik and Cvijanović, stating that there is no reasonable suspicion that the accused committed a criminal offense.

In response, the IGK declared its intention to continue working with the Prosecutor's Office of Bosnia and Herzegovina and Chief Prosecutor Kajganić, emphasizing that truth and justice stand with the victims. The IGK vowed to persist in its legal battle to ensure that all war criminals are brought to justice, and that those who deny crimes or protect criminals and crime deniers face the consequences.

“There is no difference between criminals and those who deny crimes. Some criminals may evade justice, but they should never find peace,” the IGK stated.
