Dodik: RS entity Law on Immovable property will be applied, despite OHR decision

The President of Bosnia’s Republika Srpska (RS) entity, Milorad Dodik, said that the RS Immovable Property Law which the High Representative of the international community suspended on Monday will still be applied in the entity.

After an extraordinary session of the Peace Implementation Council, High Representative Christian Schmidt used his Bonn Powers to suspend the “RS Law on Immovable Property Used for Functioning of Public Authority”. The RS National Assembly adopted the Draft Law in an urgent procedure in December. According to this law, all immovable property used by the authorities of the RS, local self-government units, public companies, public institutions and all other services established by that BiH entity belongs to the entity.

Last week, the Office of the High Representative (OHR) requested that the Constitutional Court of BiH urgently react regarding the disputed law in order to prevent “irreparable damage”.

Since the Constitutional Court did not act, Schmidt decided to take action.

Commenting on the decision, RS President Dodik, who never accepted Schmidt’s authority, said that, “from a legal point of view, nothing happened in Sarajevo” on Monday.

He argued that two permanent members of the UN Security Council never confirmed Schmidt’s appointment and that “not just any traveller can interfere in the internal affairs of BiH and the RS”.

“The Republika Srpska adopted the Law on Immovable Property, which remains in force,” he declared.

The President of the National Assembly of Republika Srpska, Nenad Stevandic, echoed Dodik’s statement, saying that the RS will “apply what the National Assembly passes, not what Christian Schmidt declares”.

“I'm sorry that we can't suspend him and his decisions because we don't recognize his authority,” Stevandic said.
