BiH Presidency Chairman Sefik Dzaferovic, sent a request to the BiH Constitutional Court to review the constitutionality of the Decree on the Control of Public Procurement in all institutions founded by the Sarajevo Canton (KS).
Dzaferovic believes that this act, which was adopted by the Sarajevo Canton Government, is not in accordance with the Constitution and he asked the Constitutional Court to put it out of force.
“The Decree of the Sarajevo Canton Government on the Control of Public Procurement is unconstitutional because it was passed by an unauthorized body, and its content is contrary to the provisions of the Law on Public Procurement. By acting in this way, the KS Government calls into question the principle of the rule of law in BiH, and especially violates the provisions of the Law according to which lower levels of government are obliged to assist the state of BiH in fulfilling its international obligations – which the public procurement on the basis of the Stabilization and Association Agreement with the European Union certainly is,” the Presidency Chairman’s Cabinet said in a statement, among other things.
They concluded by saying that it is inadmissible for lower levels of government to try to take over the powers of the state, regardless of whether it is the Republika Srpska entity, Sarajevo Canton or any other lower administrative unit.
