Election commission members accused of breaching FBiH Constitution

The Democratic Front (DF) filed Wednesday a criminal complaint against Bosnia's election commission members regarding the commission's latest decision to distribute seats in Bosnia's Federation (FBiH) entity Parliament according to the 2013 census.

DF said in the report that the Central Election Commission (CIK) members ignored the Constitutional Court's decision according to which it is the sole responsibility of the Parliament of Bosnia and Herzegovina to solve the allocation of seats in the Federation's House of Peoples.

The complaints were submitted to the State Investigation and Protection Agency (SIPA) and the Prosecutor's Office of Bosnia and Herzegovina.

“Furthermore, by deciding to use the 2013 population census for appointing the House of Peoples, it is entirely clear that the Central Election Commission, its five members that is, violated provisions of the Federation of Bosnia and Herzegovina's Constitution,” said DF.

The commission decided on Tuesday that the House of Peoples of Bosnia's Federation entity would be formed on the grounds of the 2013 population census results.

It also decided the seats would be allocated in line with a principle where each of ten FBiH's cantons would delegate an elected representative of each of three major ethnic groups (the Bosniaks, the Croats and the Serbs) to the House of Peoples.

The constitutional provision ordering such nomination was challenged at Bosnia's Constitutional Court by a Bosnian Croat politician and the court has not yet decided on this matter.

“We also find that by the very same decision and legalising the 2013 population census while ignoring the fact that the said census is a result of war developments from the 1991-95 period, the aforementioned CIK members committed a crime of denying genocide, crime against humanity and war crimes that were determined by decisions of the International Court of Justice and the International Criminal Tribunal for former Yugoslavia,” said a DF's statement.
