BiH Competition Council fines all three public emitters

Bosnia’s Competition Council found that the public broadcasters BHRT, FTV and RTRS abused their joint dominant position on the market for the sale of television advertising services and were fined 50,000 Bosnian marks (around €25,000) each, while their advertising service price lists were also declared null and void.

The Competition Council decided on TV OBN's request to initiate proceedings, and in this case, the company Media Pool Sarajevo was also fined 50,000 marks (some €25,000). It was established that the public broadcasters entered into a prohibited agreement with this company.

Namely, the Council established that the price lists of all three public TV services contain identical provisions. More favourable discounts are given to advertising agencies compared to direct advertisers, and the discount percentage depends on the amount of the order.

The Council noted that the price lists, as they were made, indisputably led to market distortion and unhealthy competition.

The Council’s decision also prohibited BHRT, FTV and RTRS from any future similar actions.
