The Presidency of Bosnia and Herzegovina adopted at an extraordinary session on Tuesday the conclusions stating that the authorities of the Republika Srpska (RS) entity were threatening the foundation of the Dayton Agreement and thus peace in the country and the region.
It also called on the international community to react and take measures to prevent the escalation of the crisis.
The BiH Presidency convened at the request of the Bosniak member, Denis Becirovic, who also proposed the conclusion, and they were supported by the Croat member, Zeljko Komsic and opposed by the Serb member, Zeljka Cvijanovic.
According to Becirovic and Komsic, the efforts of the RS authorities, led by Milorad Dodik, to undermine the Constitutional Court of Bosnia and Herzegovina represent a clear violation of the constitution.
Due to the obvious threat to the Dayton Agreement, strong and timely action by the Office of the High Representative (OHR) is necessary with the aim of protecting peace and stability in Bosnia and Herzegovina. Representatives of the international community, primarily the witness states of the Peace Agreement, and especially representatives of the European Union, should stop tolerating the anti-Dayton and the anti-constitutional policy of the authorities of the RS entity, the conclusions read.
Therefore, they called for the urgent introduction of sanctions against those destroying the constitutional order, and they called on Serbia and Croatia as signatories of the Dayton Agreement to respect the principle of sovereign equality of states and the principle of non-intervention in interior and foreign affairs of other states.
Cvijanovic, who voted against the conclusions, announced that she would initiate a mechanism for the protection of vital national interests before the RS parliament to prevent their entry into force.
Cvijanovic considers that by passing the law on the non-application of decisions by the BiH Constitutional Court, which was annulled by High Representative Christian Schmidt, the parliament of the RS did not violate the constitution but indicated deviations in its implementation.
