The Constitutional Court of Bosnia and Herzegovina has temporarily suspended the Election Law of Republika Srpska (RS) entity following an extraordinary session on Wednesday. This decision came after Denis Zvizdic, Deputy Speaker of the House of Representatives, challenged the law's constitutionality.
The contested Law, passed by the RS National Assembly on April 19, 2024, and enacted on July 17, 2024, is now suspended, pending the Court's final ruling.
The Court highlighted serious constitutional concerns, noting that the RS law overlaps with the state Election Law and grants the RS Election Commission powers reserved for the Central Election Commission of BiH. This dual regulation could disrupt the constitutional order and political stability of the country.
The Court noted that maintaining fair and transparent elections is crucial. Implementing the RS Election Law could undermine the state Commission's role and jeopardize the integrity of the upcoming local elections. This poses a significant risk to the democratic and legal process, potentially leading to political instability.
The court clarified that this temporary measure does not assume the final decision on the Law's constitutionality.
