Bosnian officials submit Constitutional Court appeal against RS laws

Authorized representatives of Bosnian officials, including Denis Becirovic, a member of the Presidency of Bosnia and Herzegovina, Denis Zvizdic, Speaker of the House of Representatives of the Parliamentary Assembly of BiH, and Kemal Ademovic, Deputy Speaker of the House of Peoples, have submitted an appeal to the Constitutional Court of BiH. The appeal requests a constitutional review and a temporary measure following the signing of a decree by Republika Srpska President Milorad Dodik, which enacts unconstitutional laws banning the work of the Court, Prosecutor’s Office, High Judicial and Prosecutorial Council (VSTV), and the State Investigation and Protection Agency (SIPA) in the RS entity. These laws were subsequently published in the Official Gazette of RS.

Becirovic’s office announced that in response to the anti-Dayton and unconstitutional laws passed by the National Assembly of Republika Srpska (NSRS), which attempt to challenge the entity’s subordination to the sovereignty of Bosnia and Herzegovina, he and his legal team have prepared requests for constitutional review.

The statement also confirmed that Becirovic, along with Zvizdic and Ademovic, will coordinate their efforts in appealing to the Constitutional Court of BiH.

“The unlawful actions of RS entity authorities require decisive and unified action from all state officials in Bosnia and Herzegovina. Brutal attacks on the Dayton Peace Agreement and Bosnia and Herzegovina’s constitutional order must be stopped. Attempts to undermine the country’s independence, sovereignty, and territorial integrity pose a direct threat to peace and stability in the state and the region,” Bećirović’s office stated.

The statement emphasized that Becirovic will continue to fight for the enforcement of constitutional and legal principles using all available legal and political means.

Denis Zvizdic also announced on Facebook that Becirovic, Ademovic, and himself, as authorized state officials, have formally submitted the appeal to the Constitutional Court of BiH. The appeal demands a temporary measure following the enactment and publication of the unconstitutional laws banning key judicial institutions from operating in RS.

Zvizdic underscored that the BiH Prosecutor’s Office, the Court of BiH, and SIPA will continue their work to protect the country’s territorial integrity, sovereignty, and constitutional order. He emphasized that sanctioning those who undermine the constitutional system, peace, and stability remains their primary jurisdiction, right, and duty.
