Two defendants are accused of having acted contrary to the provisions of the Geneva Conventions on the Protection of Civilians in Time of War as members of the Territorial Defence of the then Republic of BiH in the area of Kotor Varos during the war and armed conflict.
The Prosecutor of the Special Department for War Crimes filed an indictment against Mirsad Smajic, AKA "Mire," born in 1964 and Nijaz Smajic aka. "Nietzsche", born in 1961.
The defendants are accused of having committed a criminal offence - a war crime against the civilian population. The Prosecutor's Office will prove the charges by calling 16 witnesses, and 2 expert witnesses and submitting dozens of material evidence. The indictment was forwarded to the Court of BiH for confirmation.
