Criminal complaint filed against RTRS for inciting ethnic hatred

The Association of Victims and Witnesses of Genocide has filed a criminal complaint with the Prosecutor's Office of Bosnia and Herzegovina against those responsible at Radio-Television of Republika Srpska (RTRS). The complaint alleges that a television report aired on December 18 during the program "Pecat" created a narrative capable of inciting national hatred, discord, and intolerance.

Signed on December 22, the report by the Association claims that the purchase of real estate in Istocno Sarajevo by citizens of Bosniak ethnicity was portrayed not as an isolated act, but as a collective and planned activity of one ethnic group intended as a threat to another community. According to the complaint, this method of reporting resulted in the ethnic problematization of a completely legal action, the purchase of property, and placed ethnic identity within the context of an alleged threat.
The document further emphasizes that this narrative was constructed through specific word choices, suggestive questioning, and contextualization, while lacking balanced views or clear distinctions between facts and insinuations. The Association asserts that these actions create an atmosphere of mistrust, fear, and hostility.
Invoking Article 145a of the Criminal Code of Bosnia and Herzegovina, the Association argues that these actions potentially constitute the criminal offense of inciting national, racial, or religious hatred, discord, or intolerance. The complaint proposes that the Prosecutor's Office of BiH analyze the complete video report and investigate the responsibility of RTRS officials to determine if elements of a criminal offense are present.
