German Embassy: RS moves are dangerous, recent decision legally void

The adoption of the Law on the Non-Enforcement of the Decisions of the Constitutional Court of Bosnia and Herzegovina on the territory of the Republika Srpska entity represents a "dangerous step towards the dissolution of the entities from the state," and the Federal Government of Germany, as well as the European Commission, are "withholding financial support for large infrastructure projects" from that entity due to the "secessionist direction" that entity it is taking, said the German Embassy’s response to N1.

“The decision of the parliament of the BiH entity Republika Srpska on the validity of the decisions of the Constitutional Court of Bosnia and Herzegovina on the territory of the RS grossly violates the spirit and letter of the country's Constitution and the Dayton Peace Agreement from 1995, which have been the guarantors of peace in the country for almost three decades. This is yet another further, dangerous step towards the dissolution of the entity from the state,” the Embassy stated.

They noted that the competence and role of the BiH Constitutional Court “directly derives from the Constitution of the country”, and that the decisions of that Court, according to the Constitution, “are final and binding and must be respected by all parties.”

“No entity parliament has the right to annul the decisions of the Constitutional Court or order their non-enforcement. The decision of the RS National Assembly, therefore, has no legal basis and is legally and politically irrelevant. That decision contributes to the decline of Bosnia and Herzegovina, which recently received EU candidate status in December. This harms the interests of citizens of this country”, they warned.

“Just as the European Commission does, so does the Federal Government of Germany withhold financial support for large infrastructure projects from the Republika Srpska due to the secessionist direction that the RS is taking,” the Embassy statement concluded.
