It's been a year since genocide denial was banned in BiH, no indictments so far

It has been a year since the former High Representative of the international community, Valentin Inzko, imposed the ban on genocide denial, and while more than 50 criminal complaints were submitted based on this law so far, none of them resulted in an indictment.

This information was confirmed for the Balkan Investigative Reporting Network (BIRN) by the BiH Prosecutor’s Office.

The former head of the Srebrenica municipality, Camil Durakovic, was the first to file a complaint based on Inzko’s law only days after it came into force against a journalist working for the public broadcaster in Bosnia’s Republika Srpska (RS) entity, RTRS.

At the end of August 2021, the Institute For Research of Genocide Canada (IGC) submitted a criminal complaint to the BiH Prosecutor's Office against Milorad Dodik, one of the three members of Bosnia’s Presidency, over his continuous denial of the genocide in Srebrenica.

Then, on October 15, 2021, the IGC filed a criminal complaint against RS entity President, Zeljka Cvijanovic, on the same grounds.

About a month later, a criminal complaint was filed against Marko Ivas, a journalist from the Tanjug news agency, for denying the genocide in Srebrenica during an interview with BiH Presidency member, Zeljko Komsic.

BiH Prosecutor Oleg Cavka told BIRN that the Prosecutor's Office undertook investigative actions in most of the cases that were reported and ordered police agencies to collect evidence. However, he said that prosecutors did not find that those were cases which could end in a conviction.

The Mothers of Srebrenica association noted that after the ban on denial of genocide was imposed, the National Assembly of Bosnia’s Republika Srpska (RS) entity adopted a decision that Inzko’s law will not be implemented on the territory of the entity. However, the BiH Constitutional Court later declared the RS decision unconstitutional.

“Genocide deniers are identical to war criminals and not prosecuting deniers is in fact a continuation of blockades and obstruction of the state strategy for the prosecution of war criminals, which today is called the Revised Strategy”, the Mothers of Srebrenica said.
