
The National Assembly of Bosnia and Herzegovina’s Republika Srpska (RS) entity has adopted a series of controversial draft laws that include banning all activities of BiH state institutions that were formed after the 1995 Dayton Peace Agreement on the territory of the RS, as well as a draft law aimed at creating a register of non-profit groups receiving foreign funding. The move comes a day after the BiH Court issued its verdict against RS President Milorad Dodik.
The proposed law on the non-application of laws and the prohibition of the functioning of “non-constitutional institutions of BiH” was adopted in the National Assembly of Republika Srpska with 49 votes in favor and 3 against. The draft law entails the prohibition of the work and actions of the Court of BiH, the Prosecutor's Office of BiH, the State Investigation and Protection Agency (SIPA), and the High Judicial and Prosecutorial Council of BiH in the RS.
The Law on the High Judicial and Prosecutorial Council of RS was adopted with 49 votes in favor and 3 against. This means that a paralel High Judicial and Prosecutorial Council will be established in RS.
The Proposal for an amendment to the Criminal Code of RS was adopted, as well as the Decision stating that it will come into force the day after being published in the Official Gazette of RS. This introduces a new criminal offense of disrespecting or failing to implement decisions of institutions or bodies of the RS.
The law defines the punishment for public officials and responsible individuals working in institutions of RS and BiH who fail to implement, disregard, or obstruct the execution of decisions made by RS institutions.
Prison sentences ranging from six months to five years are foreseen, along with measures prohibiting the exercise of a profession, activity, or duty.
The Proposal for the Law on the Special Register and Transparency of the Work of Non-Profit Organizations, known as the Law on NGOs, was adopted in the National Assembly of RS, along with the Decision on its entry into force the day after being published in the Official Gazette of RS.
The law foresees the establishment of a Special Register of non-profit organizations founded in the RS that are financially or otherwise assisted by foreign entities, which designates them as agents of foreign influence.
NGOs will be required to submit financial reports to the Ministry regarding contributions, donors, and how the funds are spent.
