UN Tribunal rejects early release request for Ratko Mladic

Graciela Gatti Santana, President of the International Residual Mechanism for Criminal Tribunals, has dismissed an application for the early conditional release of Ratko Mladic on humanitarian grounds. Mladic is currently serving a life sentence for genocide in Srebrenica and other atrocities committed during the Bosnian conflict.

Legal representatives for Mladic submitted the petition on August 18, seeking his immediate transfer to a designated medical facility or palliative care unit in Serbia, subject to local oversight and any stipulations set by the tribunal president.

The application rested primarily on arguments concerning his anticipated end-of-life status and the necessity for increased familial presence. Tribunal records indicate that President Gatti Santana received a clinical assessment on August 14 showing rapid physical decline, with medical staff confirming he had entered his final weeks and care had shifted entirely towards palliative comfort.

According to BIRN BiH, the president's August 20 ruling noted that while medical projections indicated death could occur imminently, humanitarian factors did not warrant the exceptional measure of early discharge, nor did the broader interests of justice require it.

President Gatti Santana stated that proper criminal administration does not demand release on humanitarian grounds given the gravity of a life sentence, adding that Mladic continues to receive full respect for his inherent human dignity under existing arrangements.

Consultations with fellow judges revealed a divided bench, with Aminatt Lois Runeni N’gum, Seymour Panton, and Mustapha El Baaj voting to dismiss the petition, while Alphons Orie and Prisca Matimba Nyambe favoured granting it.

Mladic, formerly commander of the Army of Republika Srpska, received a whole-life tariff in June 2021 following convictions for the Srebrenica genocide, persecution of Bosniaks and Croats, the terrorising of Sarajevo, and the hostage-taking of UNPROFOR personnel. Previous health-related appeals lodged by his legal team have similarly been turned down.
