BiH Constitutional Court received no requests regarding RS Medicines Agency

The Constitutional Court of BiH has not yet received any request for review of the constitutionality of certain decisions regarding the Republika Srpska (RS) entity Medicinal Products and Medicinal Devices Agency, the Court confirmed for N1 on Tuesday.

Activities in the case of the attack on the constitutional order of BiH are also being carried out by the country’s Prosecutor's Office and so far representatives of the opposition have been questioned on that issue, as well as some representatives of the ruling majority in the RS.

In the meantime, the Constitutional Court of BiH received a request for the review of the constitutionality of the Declaration on Constitutional Principles adopted on December 10, 2021, in the RS parliament. Four other conclusions were submitted regarding the decisions and conclusions adopted at the same session.

With 52 votes in favour and with most of the opposition deputies in the hall, the RS National Assembly adopted the information on the transfer of competencies in the field of indirect taxation, justice and defence and security, as well as the Declaration on Constitutional Principles.

The Declaration states, among other things, that “all laws imposed by the High Representative are unconstitutional.”
Competences that are not explicitly assigned to BiH institutions under the BiH Constitution belong to the entities, but Article III states that BiH may take over competencies from the entities if consent for such a thing exists.
