BiH Court clarifies verdict: Dodik faces broader legal ban

The Court of Bosnia and Herzegovina has issued a detailed clarification regarding the final verdict against Milorad Dodik, President of the Republika Srpska entity, following growing media inquiries about the security measure imposed and the legal consequences of his conviction.

Dodik was found guilty of failing to implement decisions of the High Representative and sentenced to one year in prison. In addition, the Court imposed a six-year security measure prohibiting him from holding the office of President of Republika Srpska. On appeal, this first-instance verdict was upheld in full, making it legally binding.

In its clarification, the Court reaffirmed that the imposed security measure, a six-year ban from serving as President of Republika Srpska, remains in force. This measure, as the Court explained, is a criminal sanction directly linked to the nature of the offence and the public office Dodik held at the time of the criminal act. According to Article 203a, Paragraph 4, in conjunction with Article 73 of the BiH Criminal Code, the Court was legally obliged to impose this measure in response to his conduct while acting as President.

However, the Court stressed that the legal consequences of the conviction extend significantly beyond the imposed security measure.

Unlike security measures, legal consequences under Article 203a, Paragraph 5, Points a), c), and d) of the Criminal Code of BiH are not criminal sanctions and are not explicitly stated in the verdict. Instead, they take effect automatically by the force of law. These consequences are not determined or imposed by the court; they apply directly and immediately upon the finality of the conviction.

Most notably, the Court emphasised that while the six-year ban from holding the Presidency is specific to the role in which Dodik committed the offence, the legal consequences of his conviction, as stipulated by law, clearly imply a broader restriction on public and political activity. These consequences will apply automatically and encompass a wider scope than the security measure itself.
