BiH Prosecution: SIPA requested to assist in summoning Dodik et al.

The Prosecutor’s Office of Bosnia and Herzegovina has issued an order to summon Milorad Dodik, the president of the Republika Srpska (RS) entity, Prime Minister Radovan Viskovic, and National Assembly Speaker Nenad Stevandic for questioning. Jelena Miovcic from the State Investigation and Protection Agency (SIPA) confirmed for N1 that SIPA has been requested to assist in executing this order.

According to multiple legal interpretations obtained by N1, judicial police can bring the three officials in for questioning with assistance from any police agency. The BiH Prosecutor’s Office has the authority to summon individuals twice, and if they fail to comply, an order for their detention may follow.

If Dodik, Stevandic, and Viskovic refuse to comply with the detention order, a domestic arrest warrant could be issued, followed by an Interpol warrant if necessary.
The RS public broadcaster RTRS reported that assistance from the RS Ministry of Interior has also been requested.

The BiH Prosecutor’s Office has accused the three officials of committing the criminal offense of "attacking the constitutional order." However, there has been no official confirmation of the summons from the prosecutor’s office at this time.

This legal development follows the publication of the 19th issue of the RS Official Gazette, which includes decrees on four laws adopted by the RS National Assembly on February 27. These laws have been deemed unconstitutional, as they aim to prohibit the operations of the BiH Prosecutor’s Office, BiH Court, High Judicial and Prosecutorial Council (VSTV), and SIPA within RS territory.
