The National Assembly of BiH's Republika Srpska (RS) entity adopted the "Information on the Destruction of the Constitution of Bosnia and Herzegovina – Measures and Tasks for the Preservation of the BiH Constitution". It concluded that the Court of Bosnia and Herzegovina "has carried out an act of coup and a complete dismantling of BiH’s constitutional order by issuing a verdict based on the decision of High Representative Christian Schmidt, rather than on a law passed by the BiH Parliamentary Assembly."
In the conclusions, the RS National Assembly established that it rejects all decisions made by Schmidt and deems null and void all laws and decisions of bodies not defined by the BiH Constitution, primarily the High Judicial and Prosecutorial Council, the Prosecutor's Office of BiH, the Court of BiH, and the BiH Agency for Investigation and Protection.
The Assembly asserts that the BiH Court’s decision to issue rulings based on a decree imposed by an individual is contrary to the BiH Constitution and that, by acting in this manner, the Court of BiH has dismantled the constitutional order of Bosnia and Herzegovina.
The lawmakers demand that the Republika Srpska Attorney's Office file criminal charges against all prosecutors of the BiH Prosecutor’s Office and judges of the BiH Court who acted upon the imposed decision for organizing, planning, and preparing criminal acts against the constitutional order. The criminal charges will be submitted to the Prosecutor’s Office of the Federation (FBiH) entity of BiH and the Prosecutor’s Office of Republika Srpska.
The National Assembly of Republika Srpska instructs the Government of Republika Srpska to prepare and submit laws to the Assembly that will ban the operation of institutions not defined by the BiH Constitution on the territory of Republika Srpska, particularly the High Judicial and Prosecutorial Council of BiH, the Court of BiH, the BiH Prosecutor’s Office, and the BiH Agency for Investigation and Protection, as stated in the conclusions.
The National Assembly strongly condemns the actions of the BiH Prosecutor’s Office against members of parliament in the Assembly, stating that such actions, carried out within their official duties, are aimed at intimidation and political neutralization. The Assembly opposes any measures taken by the BiH Prosecutor’s Office or other bodies acting under its orders against parliamentary representatives.
These conclusions take effect immediately upon adoption.
