The head of the "Forgotten Children of War" Association, Ajna Jusic, said that she waited 30 years for her country to even recognize her status through a law that was passed in Bosnia’s Brcko District this year, but noted that even today it is not possible to determine with certainty the number of children who were born as a result of the war, nor the number of mothers who were discriminated against on several grounds.
On July 14, 2022, the Brcko District passed the Law on Civilian Victims of War, which involved the legal recognition of children born as a result of wartime sexual violence. A draft law for Bosnia’s Federation (FBiH) entity has meanwhile also been prepared.
“Children whose fathers were killed or otherwise damaged by the war have received certain rights and we welcome that, but what about our mothers? Why are we not equal on that maternal line? Through this law, through this recognition, this is an issue that we are addressing,” she said.
The law in Brcko District is a reflection of recent events in international politics, which includes the recommendations of the UN Secretary General, the UN human rights body, as well as the decisions of international courts. Certain deficiencies that the new Draft Law have also been identified.
According to Amina Hujdur, from TRIAL International, the draft Law of the Government of BiH’s Federation (FBiH) has “greatly advanced from what we had in Brcko District, bearing in mind that certain rights are provided for children when it comes to numerous aspects of support.”
“First of all, we are talking about support for solving their housing issue, legal and psychological support”, she explained.
Many children born as a result of war face stigmatization, which is why legal changes are necessary.
According to neuropsychiatry expert, Amra Delic, “studies showed that in addition to these bad socio-economic conditions, they also have increased risks to their health and social exclusion due to the fact that they were stigmatized and discriminated against.
