
The Constitutional Court of Bosnia and Herzegovina, during its 153rd plenary session in Sarajevo, annulled a section of the history curriculum for ninth-grade students in Republika Srpska. The decision specifically pertains to the topic "Republika Srpska and the Defensive-Patriotic War" included in the curriculum.
The Court determined that Article 4, Paragraph (1), Point 12 of the Rulebook on the Curriculum for Primary Education in Republika Srpska, along with Annex 20, which outlines the history curriculum for ninth-grade students, violates Articles I/2 and III/3.b of the Constitution of Bosnia and Herzegovina. It also contradicts the standards set by the Framework Law on Higher Education and the Common Core of educational standards adopted by state institutions.
As a result, the Court has invalidated these provisions, which ceased to be effective as of their publication in the “Official Gazette of Republika Srpska.”
Furthermore, the Court's ruling prohibits the teaching of history based on pages 185–192 of the textbook “History for Ninth Grade of Primary School,” published by the Public Company “Institute for Textbooks and Teaching Materials” in East Sarajevo. This textbook edition, approved by the Ministry of Education under Decision No. 07.041/052-4017-1/18 on June 25, 2018, will no longer be used in classrooms.
The implementation of the Court's decision has been assigned to the Minister of Education and Culture of Republika Srpska and the Director of the Republika Srpska Pedagogical Institute.
This ruling underscores the Constitutional Court's commitment to upholding educational standards and ensuring that curricula align with Bosnia and Herzegovina's constitutional framework and laws. It also highlights the challenges of reconciling differing historical narratives within the country's complex political and educational systems.
