The British Embassy to Bosnia and Herzegovina called Tuesday’s Republika Srpska (RS) entity National Assembly decision to ban the implementation of BiH Constitutional Court decisions on the territory of this entity – reckless and illegal.
“Yesterday's Republika Srpska National Assembly session endorsed an illegal and reckless move which has no legal standing in Bosnia and Herzegovina. The Dayton Peace Agreement and the BiH constitution make very clear the primacy of the Constitution and of the Constitutional Court of BiH,” the Embassy said Wednesday.
“The ruling RS coalition cannot unilaterally rewrite the fundamental basis of the country. No entity has the right or ability to question the supremacy and integrity of the Constitutional Court of BiH. A well-functioning BiH requires the engagement and input of all groups across the country. This is the core of the Dayton Peace Agreement. Republika Srpska's elected representatives have chosen to prevent people in RS from having their voice in the Constitutional Court. This is an unwise move which will only benefit those playing political games at the expense of peoples’ lives,” they concluded.
The move was also condemned by the US Embassy with a similar statement, and the Troika members of the ruling state-level coalition, namely the Social Democratic Party (SDP), People and Justice Party (NiP) and Our Party (NS) while remaining coalition partner, the Croat Democratic Union (HDZ BiH) have remained silent so far.
Bosnia’s legal experts have called the move a form of a coup, urging state institutions and the state Prosecution to act urgently, and the BiH Presidency member Denis Becirovoc gave the international community, as the guarantor of the Dayton peace Agreement’s implementation, seven days to act. Bosnia’s Croat Presidency member Zeljko Komsic said that international community representatives are talking nonsense while the leader of the RS majority party – the Alliance of Independent Social Democrats (SNSD), Milorad Dodik is heading into an aggression against Bosnia.
