CoE Secretary General condemns RS entity decisions on BiH Constitutional Court

Marija Pejcinovic-Buric, the Secretary-General of the Council of Europe, strongly condemned the adoption of the Law on the non-application of decisions of Bosnia's Constitutional Court in Republika Srpska entity, stressing that the decisions of this court are “legally binding” on the whole territory of Bosnia and Herzegovina.

“I strongly condemn the adoption of the Law on the non-application of decisions of the Constitutional Court of Bosnia and Herzegovina in Republika Srpska by the National Assembly of Republika Srpska. The decisions of the Constitutional Court of Bosnia and Herzegovina are final and legally binding on its whole territory. Such attempts to undermine the constitutional and legal order of the country, contrary to the fundamental principles of the rule of law, are not acceptable,” the CoE Secretary-General said.

She reiterated the support to the authority of the Constitutional Court.

“It remains an institutional guarantor for the protection of human rights and rule of law in the country, as confirmed in the judgments of the European Court of Human Rights. Legal certainty must be ensured for all citizens of Bosnia and Herzegovina. The Council of Europe will continue to assist and support Bosnia and Herzegovina in implementing its reform agenda, aimed at strengthening human rights, democracy and the rule of law,” she said.
