The Constitutional Court of Bosnia and Herzegovina has issued a temporary measure, suspending the application of the Curriculum Regulation in the Republika Srpska regarding the History subject for 9th-grade students, which portrays war criminals as heroes.
The Court held an extraordinary session to review case U-20/24, following a request submitted by 13 members of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina. They sought a constitutional review of the regulation related to the subject “Republika Srpska and the Defensive-Fatherland War.”
In its ruling, the Constitutional Court temporarily halted the application of the disputed parts of the Regulation, citing concerns about serious and irreparable harm. The Court emphasized that enforcing the curriculum in its current form could lead to further segregation and division among students from different ethnic backgrounds, fostering feelings of exclusion and marginalization.
The Court's decision is effective immediately and will remain in place until a final ruling is made. However, it stressed that this temporary decision does not affect the overall assessment of the case's constitutionality.
