Court halts construction and logging on Jahorina amid land dispute

The Court of Bosnia and Herzegovina has issued a temporary measure prohibiting investment works and deforestation at the Vuciji Most site on Mount Jahorina, Radio Free Europe reports.

The decision, made on December 30, 2024, followed a proposal by the Office of the Attorney General of BiH, acting as the legal representative of Bosnia and Herzegovina. According to the Court, the measure bans investment and logging activities at Vuciji Most in accordance with the regulatory plan for the special Jahorina area.

The temporary measure applies to land included in a Republika Srpska (RS) government decision to sell property via public auction within the designated Jahorina area. This order will remain in effect until the final conclusion of litigation initiated by the Office of the Attorney General of BiH.

In early 2024, the RS government sold 56,400 square meters of state land on Jahorina for approximately €21 million. However, on July 11, 2024, the Constitutional Court of BiH annulled the sale, instructing the RS government to reverse all related actions.

The Constitutional Court clarified that the land in question constitutes state property, which entities are prohibited from managing or selling. Despite this ruling, the land was registered under the ownership of a private company, “Drvo-Export,” based in Teslic.

On November 14, 2024, the Constitutional Court announced that the RS government and its representatives had failed to implement the decision declaring the sale unconstitutional. The Court subsequently notified the BiH Prosecutor’s Office of the violation.

Since 2005, state property in BiH has been under a legal moratorium on disposal, introduced by the then-High Representative Paddy Ashdown. This law remains in force until domestic authorities enact new legislation to resolve the issue of state property allocation, but no political consensus has been reached to date.

Despite the legal restrictions, RS authorities have continued selling state property, asserting that it belongs to the entity.
