Azra Zornic, the appellant before the European Court of Human Rights in Strasbourg, filed a criminal complaint against Croat Democratic Union (HDZ BiH) leader Dragan Covic for not implementing her verdict.
She won the case against Bosnia almost ten years ago. Zornic appealed to the European Court of Human Rights because she could not participate as a candidate in the elections for the House of Peoples and the Presidency of BiH because she does not identify as a member of any of the major ethnic groups (Bosniak, Serb or Croat).
In explaining its decision, the Court found, among other things, that this case is identical to the earlier case “Sejdic and the Finci”, because Zornic was also prevented from participating in the elections for the House of Peoples based on her ethnic origin, and concluded that the continued inability of the applicant petitions to participate in the elections have no objective and reasonable justification, which makes those provisions of the Constitution discriminatory.
