Hague Tribunal rejects Ratko Mladic’s request for early or temporary release on humanitarian grounds

The International Residual Mechanism for Criminal Tribunals (IRMCT) has denied a request by Ratko Mladic for early or temporary release on humanitarian grounds. The decision was issued by IRMCT President Judge Graciela Gatti Santana, following consultations with five judges who had previously ruled on Mladic’s appeal against his final conviction.

Mladic’s defence argued he suffers from a terminal illness and has a drastically shortened life expectancy, claiming that detention conditions hinder access to proper palliative care. However, the court determined that although his health condition is serious and requires daily medical attention, there is no acute terminal illness that would justify his release.

According to medical reports, Mladic is in stable condition with occasional improvements. He currently receives highly specialised care at the prison hospital in The Hague, supported by a multidisciplinary medical team, and has regular access to family contact.

The court concluded that his continued detention does not constitute inhumane or degrading treatment and meets the high standards of humane treatment required for convicted individuals.

The Mechanism stated it will continue to monitor Mladic’s health and ensure that he receives appropriate care and maintains communication with his family.
