Bosnia’s Chief Prosecutor, Gordana Tadic, will continue serving the post after the first-instance disciplinary commission of BiH’s top judicial institution dismissed her on Monday due to “negligence”, since her lawyer announced the decision will be appealed.
The first-instance disciplinary commission of the High Judicial and Prosecutorial Council (HJPC) dismissed Tadic and downgraded her to the position of a state prosecutor due to offences related to the automatic assignment of criminal cases and security checks.
Tadic stands accused of “negligence in performing official duties” and “failure, for unjustified reasons, to comply with the decisions, orders or requests of the Council.”
Specifically, the commission determined that Tadic assigned cases to judicial prosecutors according to her own will and not through the CMS system that automatically distributes them.
According to Tadic’s lawyer, Vlado Adamovic, this is not true and “during the proceedings it was determined that the CMS was not used that way.”
The HJPC explained that “given that this is a decision of the first instance disciplinary commission, this is not a final decision, so this decision can be appealed to the second instance disciplinary commission and, finally, to the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH) as a whole, thus the appointed Prosecutor shall continue to be the Chief Prosecutor of the Prosecutor's Office of Bosnia and Herzegovina.”
Adamovic also argued on Monday that the decision was not submitted to him and his client in accordance with the law and that press releases or media reports are not legally binding.
“Of course I will appeal. Is it normal for those involved in a process to find out decisions on it in the papers? That is crazy,” he told the SRNA news agency.
