
Marinko Djukic, who was acquitted by the Court of Bosnia and Herzegovina of crimes against humanity in the Teslic area, is now suing the state for emotional distress and financial damages.
At a preliminary hearing in his lawsuit against Bosnia and Herzegovina, Djukic’s attorney, Branko Ristic, proposed submitting several pieces of material evidence. These include court verdicts and rulings from the Court of BiH, a formal claim for damages, a document confirming Djukic’s appointment as director of the Development Agency of Republika Srpska, and medical records.
Ristic also recommended bringing in an economic expert to assess the financial losses Djukic incurred during the legal proceedings, as well as a medical expert to evaluate the severity and duration of the emotional distress he experienced due to his arrest and the restrictive measures imposed on him between 2014 and 2023.
“If he experienced fear during detention, the expert should determine its intensity and duration,” Ristic stated.
Mladen Draganic, Assistant to the State Attorney, confirmed that he stands by the previously submitted response to the lawsuit. He raised no objections to the proposed evidence and did not request additional evidence.
In June 2024, the Court of Bosnia and Herzegovina issued a final acquittal for Djukic. He had been accused of planning, preparing, and carrying out acts of murder, illegal detention, torture, and inhumane treatment of Bosniak and Croat civilians in Teslic, in coordination with members of the military-police unit “Mice.”
The court has scheduled a main hearing for September 30 to determine the amount of compensation Djukic is seeking, according to BIRN BiH.
