No investigation against Sebija Izetbegovic and others over ventilator use at Sarajevo clinic

After thorough checks and analysis of collected evidence, extensive documentation, and expert findings, the Sarajevo Cantonal Prosecutor's Office decided not to conduct an investigation against Sebija Izetbegovic, Amela Katica Mulalic, Senita Beharic, Ilijas Aslani, Ediba Celic Spuzic, Aida Coric, Selma Bavcic, Fadil Novalic, Vjekoslav Mandic, Anis Ajdinovic, and Nijaz Uzunovic, who were reported in connection with the use of ventilators at the Sarajevo University Clinical Center.

The decision followed the collection of over 10,000 pieces of evidence from 15 different institutions, including two international requests for legal assistance from the BiH Prosecutor's Office. More than 50 witnesses were interviewed, and four inspections were conducted, two of which took place in the Special Ventilatory Center of the Sarajevo Clinic (KCUS).

Nine specialized expert analyses were carried out by the Forensic Medicine Board of the Medical Faculty in Belgrade. The Faculty of Mechanical Engineering in Belgrade performed an examination of gas installations, and an inspection was conducted in the Special Ventilatory Center of KCUS.

Medical documentation for 2,600 COVID-19 patients treated at KCUS was seized. Information was obtained from other hospitals in the Federation of BiH regarding the use of ACM 812 A ventilators, as well as data from the Public Health Institute of the Federation of BiH on infection, recovery, and mortality rates from January to May 2021.

The Sarajevo Cantonal Prosecutor's Office investigated the consequences of using ventilators in the Special Ventilatory Center for treating COVID-19 patients. This judicial institution did not address the procurement or quality of the ventilators, which was a separate case before the BiH Prosecutor's Office and Court, but focused solely on their use in patient treatment and potential consequences.

Ultimately, the Sarajevo Cantonal Prosecutor's Office concluded that the use of ventilators could not be linked to the deterioration of health or the death of any patient. Investigators from the State Investigation and Protection Agency (SIPA) conducted certain investigative actions under the supervision of the acting prosecutors.

Complainants have the right to appeal this prosecutorial decision to the office of the Chief Cantonal Prosecutor, as announced by the Sarajevo Cantonal Prosecutor's Office.
