OSCE warns draft RS Constitution violates Bosnia’s constitutional order

The Organization for Security and Co-operation in Europe (OSCE) has raised serious concerns over the draft Constitution of Republika Srpska (RS), warning that it directly violates the constitutional order of Bosnia and Herzegovina. In a statement, the OSCE stressed that the proposed document poses a dangerous attempt to undermine the state’s legal framework, weaken institutional integrity, and intensify political divisions.

According to the OSCE, all elected officials and members of any parliament, including delegates of the RS National Assembly (RSNA), have a responsibility to recognize, prevent, and avoid actions that threaten democracy, the constitutional order, and the country's stability.

The warning comes after the RSNA, in a session held yesterday, adopted a decision to proceed with drafting a new RS Constitution. The move, passed without opposition delegates' support, has drawn sharp criticism due to its inclusion of provisions that the OSCE describes as “scandalous and unconstitutional.”

The international community has been closely monitoring the developments in Republika Srpska, with growing concerns that the adoption of such a constitution could escalate secessionist ambitions and further destabilize Bosnia and Herzegovina. The OSCE has reiterated the importance of upholding the rule of law and respecting the country’s existing constitutional framework, emphasizing that any unilateral attempts to change the legal order could have serious political and legal consequences.
