With 56 votes in favour of 65 MPs in total, the Law on the Non-Enforcement of Decisions of the Constitutional Court of Bosnia and Herzegovina, which prohibits the implementation of the Court's decisions in the territory of the Republika Srpska (RS) entity, was adopted Tuesday evening.
The Law states that it will be in force until the Law on the Constitutional Court of Bosnia and Herzegovina is adopted by the BiH Parliamentary Assembly.
Prior to the vote, the RS Justice Ministry accepted the Serb Democratic Party’s (SDS) amendment, so Article 1 of the Law now reads:
“The decision by which the Rules of the Constitutional Court were amended and the decisions of the Court adopted with new amendments to the Rules of the Constitutional Court of BiH, will not be applied and executed on the territory of the RS.”
Additionally, with 50 votes in favour, the conclusions of the parties of the ruling majority were passed, which envisage blocking the implementation of any of the 14 priorities on the country's European path until the Constitutional Court of Bosnia and Herzegovina is reformed.
It is stated that in addition to the issue of the reform of the Constitutional Court, the issue of closing the Office of the High Representative (OHR) should also be a priority.
“The National Assembly asks all of its elected representatives not to participate in discussions on solving any of the other EU priorities until these two previously mentioned priorities are solved,” it was stated.
In the second conclusion, the RS parliament charges the Government to submit to it Draft Amendments to the RS Criminal Code, which will prescribe a special criminal offence of acting contrary to the provisions of the Law on Non-Enforcement of Decisions of the Constitutional Court of BiH.
The third conclusion states that the RS National Assembly will pass laws or other appropriate legal acts on taking measures and actions towards those RS institutions and bodies that act contrary to the provisions of the said Law, including their abolition measures.
