RS parliament approves entity Draft Election Law, contrary to state Law

The National Assembly of the Republika Srpska (RS) entity adopted the first Draft of the RS Election Law, stipulating that elections for authorities in the RS are conducted by the the RS Election Commission. The Draft also stipulates that upon its entry into force, the provisions of the BiH Election Law governing the election of members of the RS National Assembly, delegates of the Council of Peoples of the RS, President and Vice President of the RS, delegates of the House of Peoples of the BiH Parliament from the RS, councillors of city assemblies, assemblies of municipalities, mayors, heads of municipalities, the appointment of authorities for the implementation of elections for legislative, representative and executive authorities in the RS, will not be applied.

The novelty in relation to the current Law is the regulation of the election of delegates to the House of Peoples in the BiH Parliament coming from the RS and the protection of the right to vote, which provides that this protection will be provided by the RS Supreme Court, in addition to the authorities for conducting elections.

The Draft Law will be sent to public discussion because it regulates issues that are of particular importance to citizens and on which it is necessary to consult authorities, organizations, scientific and professional institutions and interested citizens.

In his closing speech, Milorad Dodik said that he would like the RS to conduct elections according to its own Law. He is aware that, when he signs the decree of that Law, which will probably be once again repealed by High Representative in BiH Christian Schmidt, he would repeat the crime but the RS President added he was not afraid of possible consequences.

The RS parliament also adopted a series of ultimatums and demands in the form of the conclusion concerning the Draft which, in short, stipulate that Schmidt should annul his recent decision to amend the BiH Election Law, and if not, the BiH Parliament should declare it, and all other decisions he made null and void. If the Parliament does not do so, the conclusions state that RS representatives will pull out of all government bodies and coalitions at the state level and the RS will pull out of all agreements according to which it ceded competencies to the state, such as the agreement on the formation of BiH Armed Forces, Indirect Taxation Authority and the High Judicial and Prosecutorial Council and adopt the final version of its own Election Law.
