BiH Presidency member Denis Becirovic submitted a request to the BiH Constitutional Court to review the constitutionality of the Law on Immovable Property used for the functioning of public authorities in Bosnia and Herzegovina’s Republika Srpska (RS) entity.
Becirovic asked whether the said Law was is in accordance with Article II of Annex II of the Constitution of BiH, along with a series of final and binding decisions of the Constitutional Court of BiH that this entity did not execute.
In the explanation of his request, Becirovic detailed the constitutional and legal reasons and facts from which the Constitutional Court should make a decision establishing the unconstitutionality of the disputed Law, as well as establish that the RS is not competent to regulate that legal matter, which will protect the immovable property of the state of Bosnia and Herzegovina, which belongs to it both according to the Constitution and according to international law, Becirevic's cabinet said.
