The Appeals Chamber of the Court of Bosnia and Herzegovina has annulled the first-instance verdict from April 5, 2023, concerning the accused Fikret Hodzic and the legal entity F.H. Srebrena malina d.o.o., opting for a retrial.
The Court emphasized that this decision follows the Constitutional Court of BiH's ruling on November 14, 2024, which found that the defendants’ right to a fair trial had been violated. According to the Constitutional Court, the previous verdicts failed to resolve doubts regarding whether the accused fully understood the charges against them.
In response to these findings, and adhering to the Constitutional Court’s directives as the supreme authority for interpreting the Constitution and safeguarding human rights in BiH, the Appeals Chamber revisited the case. After reviewing the objections raised on appeal, it concluded that the initial ruling required annulment. Consequently, the Chamber decided to reopen the case for further deliberation.
The Court explained that the unresolved doubts surrounding the legal issues in the case necessitate substantive reconsideration, making a new hearing before the Appeals Chamber unavoidable.
