Bosnia's judicial institutions vow to uphold law amid political tensions

Sanin Bogunic, President of the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH), addressed the ongoing political crisis in an interview with Federation BiH Television (FTV). He reassured the public about the integrity and resolve of the country's judicial institutions in the face of recent challenges.

Bogunic emphasized the unwavering commitment of the judiciary and prosecution to uphold the rule of law. "Do not doubt the judicial institutions of Bosnia and Herzegovina, neither the Prosecutor's Office nor the Court. They will act in accordance with legal provisions and process this and all other cases. This particular case may be more prominent in the public eye, but it is crucial that the rights of the accused are respected. On the other hand, the state will pursue justice for everyone," Bogunic stated.

When asked about individuals who deny the legitimacy of state institutions and publicly refuse to comply with judicial summons, Bogunic responded that while it is their right to express such views, the state will act according to the law. "We can view it that way, but the state operates in accordance with regulations and the law. Do not doubt that," he affirmed.

Bogunic highlighted the determination of the Prosecutor's Office of BiH to enforce the law without fear or favor. "The prosecutors are not afraid of anyone; they aim to follow legally prescribed procedures, just as they do with all other citizens of this country. It is essential that the law applies equally to everyone," he said.

Earlier today, the Prosecutor's Office of BiH issued arrest warrants for the President of Republika Srpska (RS) entity, Milorad Dodik, Prime Minister Radovan Viskovic, and the Speaker of the National Assembly of RS, Nenad Stevandic. They are suspected of the criminal offense of "attack on the constitutional order of BiH."

In addition to the Court police, who have been ordered to execute the arrests, the State Investigation and Protection Agency (SIPA) has also been directed to participate in the operation. If Dodik, Stevandic, and Viskovic refuse to comply, international arrest warrants may be issued, potentially involving Interpol if they are not apprehended within the country.

This development follows the publication of decrees in the 19th issue of the Official Gazette of RS, which include four laws adopted by the National Assembly of RS on February 27. These laws undermine the constitutional order of BiH and aim to prohibit the operations of the Prosecutor's Office of BiH, the Court of BiH, HJPC, and SIPA within the territory of RS. The Constitutional Court of BiH has temporarily suspended these laws following appeals by Bosnian officials.
