The Constitutional Court of Bosnia and Herzegovina rejected a request to impose temporary measures to suspend the election of members of the House of Peoples of Bosnia’s Federation (FBiH) entity, which means that the process will take place according to the rules the High Representative of the international community in the country imposed on the day of the election, October 12.
The request was submitted by the Bosnian Croat member of BiH’s tripartite Presidency, Zeljko Komsic, who asked the Constitutional Court to review whether the amendments to the Election Law and Constitution of the FBiH entity imposed by High Representative Christian Schmidt are in line with the BiH Constitution.
“The Constitutional Court decided to reject the requests for the adoption of a temporary measure. According to the opinion of the Constitutional Court, the applicants did not clearly state, beyond the abstract level, what types of irreparable damage could occur if the challenged acts remained in force until the dispute was resolved, nor did they provide evidence of the justification of their requests,” the Court said in its decision.
