Dodik says RS entity to pass own law on judiciary, contrary to BiH law

Bosnia’s Republika Srpska (RS) entity will adopt the Law on entity High Judicial and Prosecutorial Council (HJCP) by the end of December of this year, Serb Presidency member Milorad Dodik said Friday.

“Bosnia’s HJCP is an unconstitutional body because the Constitution provides Bosnia with no judicial powers,” Dodik said.

The HJCP is Bosnia’s top judicial institution in charge of appointing and sanctioning judges and prosecutors in the country, that was formed in 2004 via the Law on HJCP which was adopted in the state parliament by the votes from MPs from the RS as well as the Federation (FBiH) entity.

The Law does not provide for the unilateral withdrawal of consents for its formation.

He added that the HJCP BiH was “formed on the basis of pressures and anti-Dayton actions of High Representatives in BiH which was supported by Western countries.”

Dodik also said that “the HJPC BiH was occupied by Bosniaks who want to model the country’s political system through the Court and Prosecution of BiH, which is unacceptable.”

the Serb Presidency member touched upon the threats of sanctions, calling them unreasonable and from what he heard from Germany he said was unreal.

“They can do what they want and we’ll go on our own way with our friends,” he added.

Speaking about calls to monitor monetary transactions coming in and out of the RS, Dodik said there are other financial centres, besides the Western ones.

“That [High Representative in BiH Christian] Schmidt says they can prevent the transfer of funds via bank accounts. That’s unbelievable and an unseen form of fascism,” Dodik concluded.
