After Tuesday's entry into force of the Law on Medicines and Medical Devices of the Republika Srpska (RS) entity, BiH Presidency Chairman Sefik Dzaferovic sent a request to the Constitutional Court of Bosnia and Herzegovina to review the constitutionality of this law. The same request includes amendments to the Law.
Dzaferovic asked the Constitutional Court to repeal these unconstitutional acts. He also requested that the Constitutional Court issue an interim measure, which would put them out of force until its final decision, so that their application would not cause irreparable damage during the proceedings.
The request notes, inter alia, that the impugned laws are in conflict with state laws in this area, and that they establish an unconstitutional, parallel system of infrastructure, control and rules in the trade of medicines and medical devices.
