Court fails to confirm indictment against Dodik, asks further modification

The Court of Bosnia and Herzegovina has returned the indictment against Republika Srpska entity (RS) President Milorad Dodik and acting director of the RS Official Gazette Milos Lukic to the Prosecutor's Office for further modification, it has been confirmed for N1. Some media reported that the indictment is “full of shortcomings.” Dodik himself said he would not be surprised if the case was transferred to the entity level.

According to media reports, the competent judge said that three prosecutors who worked on the indictment did not describe in details the crime that RS President and acting director of RS Official Gazette are charged with. Dnevni avaz daily learns that the indictment was returned because it was full of shortcomings in regard with the Law on Criminal Proceedings of BiH.

The indictment was issued based on the Criminal Code of BiH, Article 203, Paragraph 1, which was imposed by international community's envoy in Bosnia and Herzegovina Christian Schmidt, and it refers to the non-implementation of Schmidt's decisions on the territory of Republika Srpska entity.

“When I woke up I was informed that the indictment has been returned. It only confirms how bad it was done, that even the judge could not confirm it. Don't be surprised if the Court transfars it to Banja Luka (administrative centre of RS entity) just like it did in some previous cases, and if they say Dodik set it up,” Dodik said on Monday commenting on the latest information regarding the indictment.

He also warned that “BiH might break down on this story.”

“It might not be broken down by Dodik, but you might break it down on the story of Dodik,” he stressed without going into further details.

Dodik reiterated his stance towards Schmidt, whom he does not recognise as the High Representative in BiH, and US Ambassador Michael Murphy.

“I wish we had no problems with America, I don't even have one. I will stay here and still be Republika Srpska President, and that arrogant Murphy will no longer be an ambassador, you'll see. He is an evil guy who is showing his frustrations here. He is gathering judges and prosecutors, he's the only one who recognise that Schmidt,” said Dodik, who earlier blamed the ambassador of being behind the indictment.
