The Council for the Protection of Vital Interests within the Constitutional Court of the Republika Srpska has ruled that a request by the Bosniak Caucus to review the law governing the use of the flag, coat of arms, and anthem is admissible. The Bosniak delegates argue that the legislation infringes upon their vital national interest.
Conversely, the Council dismissed another Bosniak Caucus request challenging the Law on the Implementation of Decisions of the Commission for the Protection of National Monuments.
The review focused on whether the submitted requests by the Bosniak Caucus in the Council of Peoples of the Republika Srpska met the conditions for determining a violation of the Bosniak constituent people's vital national interest. The contested legislation includes amendments to the Law on the Use of the Flag, Coat of Arms, and Anthem, as well as the implementation law for decisions of the National Monuments Commission, established under Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina.
These laws were adopted by the National Assembly of the Republika Srpska during sessions held on November 5. The Constitutional Court of the RS confirmed that the Council evaluated the procedural admissibility of the requests as a prerequisite for a substantive decision on whether the disputed laws undermine the vital national interest of the Bosniak people.
