Following media reports that the Decree of the President of Bosnia’s Republika Srpska (RS) entity Zeljka Cvijanovic on non-application of the High Representative’s ban on genocide denial in the RS Official Gazette Tuesday, Bosniak MP in the RS parliament Alija Tabakovic told N1 a session of the leadership of the strongest Bosniak party in the country, the Democratic Action Party (SDA), will be held in Banja Luka on Friday, and its leader, Bakir Izetbegovic, will also attend it.

Tabakovic added that it is possible to make they will decide to appeal the constitutionality of the mentioned law to the Constitutional Court of BiH.

The Constitutional Court of the Serb-dominated Republika Srpska determined in late September that the vital national interest of the Bosniak people was not violated by the Law on Non-Application of the High Representative's decision to ban genocide denial, which was adopted by the RS National Assembly (the entity parliament) following the decision of the former High Representative, Valentin Inzko.

The RS Constitutional Court also found that the Bosniak vital national interest was not violated by the amendments to the RS Criminal Code, which provides for prison sentences for those who call the RS a “genocidal or aggressor creation.”

The RS Constitutional Court concluded that these laws “apply equally to all citizens.”

The appeal was submitted to the Constitutional Court of BiH so far, therefore the mentioned laws have been published in the Official Gazette without any issues.

New legal steps are expected from the Bosniak Caucus after the arrival of Bakir Izetbegovic in Banja Luka on Friday.
