BiH Court’s General Session unanimously rejected the request of Goran Bubic, the attorney of the Republika Srpska (RS) President, Milorad Dodik, to disqualify Judge Jasmina Cosic-Dedovic from presiding over the case against him and Milos Lukic.
“The decision was made unanimously,” the Court of Bosnia and Herzegovina told N1. The Court’s decision regarding the indictment against Dodik and Lukic will be made in seven to eight days. The two are charged with a crime punishable by up to five years in prison.
If the indictment is confirmed, the Court of Bosnia and Herzegovina should also decide on the measure of the ban on political activity for the RS President during the court proceedings, N1 learned unofficially.
Attorney Bubic previously said that the motion for exemption was sent at the request of Milorad Dodik, adding that the defence believes that in this case, Judge Cosic-Dedovic cannot remain in the case because there are circumstances causing reasonable doubts about her impartiality.
“Judge Jasmina Cosic-Dedovic was once a candidate for judge of the International Criminal Court in The Hague, and Milorad Dodik, then in his capacity as a member of the BiH Presidency, opposed her appointment to the said judicial position on behalf of BiH,” Bubic pointed out.
The Court of Bosnia and Herzegovina returned the indictment against the President of the Republika Srpska and Acting Director of the Official Gazette of the RS, Milos Lukic to the Prosecutor's Office of Bosnia and Herzegovina.
