RS moves to undermine BiH institutions with new law on constitutional order

The draft law includes provisions for establishing a Special Prosecutor’s Office of RS, which will be responsible for prosecuting offences defined under this legislation.

Among the 21 listed criminal offences is "Failure to comply with or execute decisions of RS institutions or authorities."

According to Article 2 of the draft law, in cases where provisions of any other RS law conflict with this law, the provisions of this law will take precedence.

The law outlines specific offenses that will be prosecuted, including:

• Attack on the constitutional order of RS 

• Threatening the territorial integrity of RS 

• Placing RS in a position of subordination or dependency 

• Murder of high-ranking RS officials 

• Kidnapping of top RS representatives 

• Armed rebellion 

• Obstructing efforts against enemies 

• Serving in an enemy military force 

• Aiding an enemy 

• Illegal formation of paramilitary and parapolice forces 

• Undermining RS’s defense capabilities 

• Sabotage 

• Espionage 

• Disclosing RS ‘state’ secrets 

• Involvement in smuggling armed groups, weapons, or ammunition into RS 

• Inciting violent changes to RS’s constitutional order 

The law also specifies that the Special Prosecutor’s Office will be led by the Chief Special Prosecutor, who will be appointed by the RS National Assembly based on a proposal from the Minister of Justice. The Chief Special Prosecutor will serve a five-year term, with the possibility of reappointment. The term may end due to resignation, reaching the mandatory retirement age, or dismissal for justified reasons.
