BiH's Republika Srpska entity might legalise paying salaries in cash to those under US sanctions

The National Assembly in BiH's Republika Srpska (RS) entity is set to discuss a proposal to amend the entity Labor Law in order to secure a method to pay salaries to those who lost their bank accounts due to US sanctions. If adopted, the amendments would make it possible to pay those employees in cash.

Due to the US sanctions, a number of people in the RS lost their bank accounts, and therefore were left without salaries. If the RS National Assembly adopts the proposal, RS President Milorad Dodik, Prime Minister Radovan Viskovic, Assembly Speaker Nenad Stevandic, BiH Presidency member Zeljka Cvijanovic and many others from the US blacklist will be able to receive their salary.

Amendments to this law will make it possible to exercise the right to earnings for an employee who is prevented from opening a current account without a valid court, administrative or other decision of the competent authority, in the way that the employer can pay the salary and other personal income based on work to the employee in cash”, the proposal says.

In cases when the payment to the salary is paid in cash, the employer has the obligation to submit a written notification to the Tax Administration about the method and the reason the payment was made way, as well as information about the person to whom the payment is made.

The proposed solution creates preconditions for realizing the rights guaranteed by the Constitution of the Republic of Srpska and the European Convention on Human Rights, namely the right to work, freedom of work and earnings, all in accordance with the positive regulations of the Republika Srpska“, the proposal says.
